What View Does The Law Have On Illegally Tipping Asbestos


Once the link between asbestos and mesothelioma was proven the British government set about banning the use of it in building materials. This step should hopefully have prevented some people from developing mesothelioma. However, it is estimated that half of Britain’s buildings still contain asbestos somewhere. This is no cause for concern because it is only if asbestos fibres are inhaled that they cause problems. However, if the asbestos is removed it needs to be tipped lawfully so that it does not become a health risk.

Fly-tipping is the illegal dumping of a hazardous or toxic material such as asbestos. While the fly-tippers themselves will bear the brunt of any punishment, if you don’t ensure people you are using are properly qualified or you allow people to dump asbestos on land that you own you will also find yourself being punished.

Most people will probably want to get specially trained contractors to remove any asbestos, but if you do remove any asbestos yourself make sure you are aware of the strict guidelines and have the necessary safety equipment to ensure you’re not putting yourself in harm’s way. The Health and Safety Executive website and your local council are two great places to start finding out about regulations and how and where you can tip asbestos.

And if you dump asbestos illegally? You’re looking at a fine of up to 50,000 in Magistrate’s Courts. This fine is unlimited in higher courts. As well as financial penalties, offenders could face community punishment orders and even a custodial sentence of up to five years.

If you’re aware of anyone that has illegally fly-tipped asbestos you should inform your local council – it could stop people becoming very ill in the future. It’s unfortunate that such penalties are needed to stop people dumping a substance as deadly as asbestos, but because some people fail to recognise how serious mesothelioma is they need to be in place.
